owner is deceased and left no will

my mother passed away and did not leave a will. her house is mortgage free. i have an older brother and sister and we have all decided i should get her house. we assume the ownership would go to the oldest child, my brother, so would we use a quitdeed form? The house is still in my mother's name.

You and your siblings will have to file an affidavit of heirship at the county recorder's office and get the property transferred in your names. Then your brother and other sister can sign a quitclaim deed and transfer the property to you.
