If one signs a quitclaim out of state, on rental property bought during marriage and faxes it to spouse, is that legitimate or does it need to be notarized with both present ? Would I stll be elgible to 1/2 ownership if getting divorced?

The quitclaim deed needs to be notarized and filed at the county recorder's office where the property is located. If this is not done, then the deed won't be considered as valid. Once you transfer the property to your wife, she becomes the owner of the property. You won't be able to claim any ownership in that property.
