If my husband quick claims our house over to me. What liability will I have if he files bankruptcy on our personal bills? Can they make us sale or will they put a lein on it for debts? Also he has his own company (DBA) will any debtors be able to get the house?
welcome theeoakhill,
transferring the property just before filing bankruptcy will be considered as fraudulent by the bankruptcy court. thus, before your husband transfers the property to you, he should take the opinion of an attorney. if your name is on the mortgage and if your husband gets a discharge from the debts, then the lender will come after you to recover the dues.
