Quit claim

Hi Ksloomis,
My boyfriend lost his job and asked me to take over the payments on his home. I made his mortgage payments for one year and then asked for a mortgage loan in my name. I got the loan, but my boyfriend was not removed from the title. His x-wife put a lien on the property for back child support for thirty two thousand dollars. His x-wife died last week but the lien is still on the property due to it being listed in her will. I am no longer with my my friend and would like to sell the home. Will I be able to do a quit claim?

I am afraid that the option of quitclaiming the property will not be a good one for you. As the ex-wife has already placed a lien on your property, quit claiming the property will not help you out rather the transfer may be considered a fraudulent one.

Hi v.jones!

Do not quitclaim property to anyone else. This will be considered as a fraud transfer and the lender may take severe actions against you. You may ask your boyfriend to pay off the debts so that the lien is removed from the property.

This is why you don't use quitclaim deeds when buying a property. No legitimate buyer is going to accept a quitclaim deed from you when buying the property for the very reason that the buyer would get the property with the lien.

I'm afraid you are stuck with the lien.
