Quit Claim Deeds and Mortgage

Posted on: 16th Nov, 2008 02:10 pm
I was reading the recorded documents and found that the property we owned and held the mortgage on, was quit claim deeded to an LLC.
The original agreement wasmade with an individual and that the mortgage was to be satisfied back in 2004. This person has not paid interest or principal since 2007, and we started Foreclosure. My mother owned the property and has since passed.
When I was researching court records I find that the property was quit claim deeded to an LCC the person owns.
Is this legal?
Hi lmelton!

As far as I know, it is not legal. You can consult an attorney and take legal action against the person. You can sue him in the court.

Thanks,

Jerry

The issue is who has title. This can be based on many factors: when was each deed transferred, when was each deed recorded, did anyone have notice of the previous transfer. There are too many questions to answer your post. Contact a local real estate attorney.
