How do I prove that I am not responsible for loan?

i signed a quit claim deed when my x and i divorced he was suppose to pay the loan off it was in our divorce papers that he was responsible for what was owed on the property.this was in washington state. it was 10 years ago since he remarried 6 weeks before he died and made a will about 4 days before his death leaving everything to his new wife. she has left the property and vowed to make my credit bad in which she has. she missed payments on the house she does not want it but she will not quitclaim it back to me . if i make the payments on the loan can the loan company put me back on deed? can i sue her for money i had to pay so she would not ruin my credit ? the loan company is sending me assumption papers to get his name off the loan and my name on the deed can they do that? help please!

The loan company will not be able to put your name back on the property deed. If the property is in the name of your ex-husband's new wife, then she will have to sign a quit claim deed and transfer the property to you. As the mortgage deed has your name on it, you would be responsible for paying it off. It would have been better if your ex-husband would have refinanced the loan in his name.

The deed is in his name only. The mortgage in still in his and my name. He left a will however leaving her everything He passed of brain cancer. Thanks for the info.

Welcome back Debra,

In that case, the new wife will have to probate the will and transfer the property in her name and then refinance the loan. Once she does so, she would become responsible for the loan.
