greetings,
i recently received a calm and unworried call from lsi in pittsburg, pa, stating: the county recorders office of metro nashville and davidson county tennessee has lost the quit claim deed i signed as part of the closing the 15th of august (2008). this call, received by my voicemail today (march 2, 2009) is nearly six months following the closing. this sounds like a scam to me. how can you lose a document which clearly has bearing on the preparing and filing of a deed of trust. fortunately, or unfortunately, i have the original deed of trust showing i own the house.
i am being asked to sign and have a new copy notarized and filed with the county recorder. since the closing, the loan, owned by avelo mortgage (d.b.a. senderra funding) has been transferred first to litton loan servicing, and then sold to wells fargo bank, n.a.'s home mortgage division, to whom i have made timely payments of my mortgage, property tax, and homeowner's policies since october (2008). wells fargo advised me of having received and having paid the property tax bill for 2008 as of december 1, 2008.
according to the quitclaim deed i signed august 15th (or the copy thereof in my possession), i am both grantor and grantee in the refinance situation and i am the only name on the document as i am "an unmarried man."
is this document loss common? what are my rights?
thanks so much,
clinton

Hi clintonjohnson,
Though such losses aren't common, they can happen sometimes. As you have the original deed with you, you are still the legal owner of the property and none can take it away from you. You can contact the county recorder's office with the original documents and ask them what could be done like whether it can be recorded again etc. If you are asked to sign a new copy of the deed and get it notarized and recorded, you can do that. I don't think there's any harm in doing so.
