do I lose marital community property if I signed quit claim

Posted on: 13th Jun, 2008 09:03 am
i signed two quit claim deeds on properties in 1997 that were acquired during marriage. I was told it would be easier for my spouse to get loans on these properties if I granted them to him. We are now divorcing. Am I entitled to part of these properties?
Welcome Loriannegreshan,

Since you have already quitclaimed the properties, therefore, I don't think you are entitled to any of the properties.

If you are divorcing there must be attorneys involved. Since the divorce and property laws differ by state I suggest consulting an attorney. Although you don't say so you may be living in a community property state in which case you probably have certain claims to the property if it was acquired during the marriage.

Hi Loriannegreshan,

Welcome to the forum.

Signing a quitclaim deed does not mean that you have transferred all your stare of the property. You should check the document whether you have singed the quitclaim deed to just add your husband on the deed.

BTW if you have just quitclaimed all your share of the property then you have no rights on the property.

Best of luck,
Larry

True, I agree with both Larry and with laphillips, any property that was jointly acquired during a marriage is community property. And with Larry to check the documentation and make sure what it says, did you just add him or did you put it completely only in his name. Either way, I would think that it is community property through the marriage.
