Death and Medicaid

Hello,

My mother passed away Aug. 13, 2007, her house was never but in a will nor did she have a will. We just found out that she quit claim deeded it to my brother six years ago 2002 which is fine with everybody. But, now medicaid send us a letter for an Estate Recovery Program, they want to to take possession of my mothers home. Can they do this, should I get a lawyer we are in the State of Colorado, PLEASE HELP US!!!!

Welcome to forums.

I think they are quite justified in sending you the letter for estate recovery program. Usually they go for the recovery after the death of the recipient. I don't think they have come to know about the quitclaim transfer. So, hopefully they have sent you the letter as a part of their duty to collect the costs of providing medicaid.
