how long after a quit claim deed is executed can medicaid place a lien against property in n.c.?...my mother's house is paid for and she wants to ensure that it goes to my brother & me after her death. she has it willed to us, but she has dementia and may require being institutionalized. i have heard that even if she deeds the house to my brother and me now, that dss can still place a lien against the property if 7 years have not passed since the
title transfer. is there any course of action we can take to prevent the possiblity of my brother and i lossing the house if my mother is institutionalized?

Hi jimhearn,
As far as I know, medicaid has a look back period of 5 years. If your mother transfers the property to you now, then she will not be eligible for the medicaid benefits for the next 5 years. You can consult an attorney and check out if she can use a ladybird deed in order to transfer the property to you and your brother.
