Quit Claim vs. Warranty Deed

Hello,

My mother's husband has been in the hospital for quit some time and will die soon (he is terminal). He has mounting hospital bills that she will not be able to pay - he is on MediCare and my mother is trying to get MediCaid approved. He is 61 or 62 and she is 68.

They own two homes (Orlando & Sarasota). How can my mother be sure she does not lose her homes - or at least one of her homes? Can she Quit claim one or both to me (her daughter) or can we do a Warranty Deed?

As far as I can understand, your mother and her husband, both are on the property deed. Any property transfer now can disqualify your mother's husband from getting Medicare or Medicaid eligibility. Thus, it would be better if your mother can contact a real attorney and take his opinion in this matter. He will let her know what steps she needs to take to save her property.
