my home and mortgage have my name and my mother in law 's name on it. and she has become ill. i am afraid she may incur medical bills that could be put against my home in form of a lien. would doing a quit claim deed to get her name off leaving only mine protect my home from this??
That's a very good question. The answer may not be simple either, because you're dealing with asset protection, which can open a can of worms depending on your individual situation and state's laws. Talk to an attorney to make sure you get good advice regarding this. Sorry I wasn't more help.
Hi clbs.
Welcome to the forum.
I agree with sweeney. If your mother in law quitclaims the property to you then she may nit get qualified for the Medicaid. So I think you can use a Ladybird deed to get exemption from the Medicaid lien. BTW consult with an attorney on the issue before taking any steps.
Feel free to ask if you have any further questions.
Best of luck,
Larry

I quit paying on my credit card bills about a year ago. I just realized I had co signed a mortgage for my son and his new wife and find my name along with theirs is on the deed. Can I remove my name on the deed so no liens can be put on the property. They have made all of the mortgage payments for the last 4 years. Thankyou
Hello arb.
Welcome to the forum.
You can take your name off from the deed by signing a quitclaim deed. But you will still be responsible for the loan as you are on the mortgage. BTW are you afraid that the payday loan company will put lien on your sons property?
