In our divorce agreement, I kept the family home and we did a quitclaim deed of the house removing my former husband. I have since lost my job and unable to make the monthly mortgage payments. My exhusband can... and would like to move back into the home (I would move out) and he will work with the bank and begin making the payments. I will be filing BK and we want to have him put back on the deed prior to this since I am the only one listed on the deed. There is no equity. Is this going to cause a problem with my BK?? If I can not add him back to the deed, what happens to the house... how can he regain ownership since he will be making the payments?
Hi l_M_Lozano,
If you transfer the property now to your ex-husband, you won't be able to file bankruptcy. You should contact your bankruptcy attorney and take his opinion before transferring property to your ex-husband.
