my husband bought a second house in 1983 with out his first wife knowing this info, so he put the loan and title in his parent's name with one conditon that after he got divorced he would take the house back in his name. a quit claim deed was done but he mother refuses to sign it over back to him. she feels if she gives him back the house that i am going to divorce him and ask for half of the house. help us..my father in-law recently passed away in march 2010 and she still refuses to move out and give us the house...what can we do?

As your husband's mother is the owner of the property, no one can force her to remove her name from the property deed. You and your husband can buy her out by offering her a certain sum of money and ask her to transfer the property to you and your husband.
