i recently went through a divorce were i had to sign a quit claim deed, i noticed one day while at the ex-husbands house that the loan/mortgage payment still comes in my name first then his name i was actually the borrower, and he was coborrower. i called finance company & ask why my name was still on it after signing quit claim deed, only to be told that my name just come off of the deed but i was still legally responsible for the loan unless he refinances it in his name only. so naturally i was upset, each time he is late they but on my credit as well as continue to harrass me about the payments, i need to know what i can do. i am still responsible for a house i cant live in, enjoy etc..... it was bad enough being with a man 19 yrs & to have worked as well as him & walk away with my car thats in his name, my kids, & my clothes.. i cant get a loan, line of credit or anything because this is sitting on my credit as a high balance, & he has been late the last several payments which affect me.. please help
Hi mfuller,
A quitclaim deed will only remove your name from the property deed. It won't remove your name from the mortgage docs. Your ex has to refinance the mortgage in his name in order to remove your name from the mortgage. Once he does so, your name will be removed from the mortgage. As your name is still on the mortgage docs, the late payments will have a negative effect on your credit report.
