Quit claim Deed

hi,

when i purchased the property my wife did sing a quit claim deed that she doesn't want to be on the loan and title, can i do anything with the property without her approval.
and how can i declare this property to non community property

Hi Jimmy,

Since your wife is neither on the title nor on the loan, you are free to do anything with the property and you do not need her approval to do so. There is no need to declare the property as non community property as it has already become a separate property since the day she gave up her share in the property.

Thanks a lot for your reply.
I just wanted to make sure about this because she is creating trouble and the deed of this property says I as a sole and separate owner of the property.
Is she able do anything later if things go wrong between us?

Hi Jimmy,

I don't think your wife can create any problem with the property in future. She has given up her property-interest and has no claim to the property. The property now will be cosidered as a separate property.

If I separate with my wife after few years and the home has some equity can my wife still claim for something.

On the deed it says a married man sole and separate owner of the property.

Hi

Your wife cannot claim anything from this property after divorce. She has quitclaimed her property interest. She has no claim in the property. The deed also mentions that when it states you are the 'sole and separate owner of the property'.

Hello,

In Feb2009 i bought a home and my wife signed a quit claim deed now things are not good between us and if we go to court for divorce what can happen to this home, can court give it to my wife?
There is no equity in this home.

Hi Jimmy!

Welcome to forums!

You have mentioned that your wife had signed a quitclaimed deed. Did she sign the quitclaim deed and remove her name from the property? If she had removed her name from the property deed, then she will have no rights to the property.
