TRANSFER OF PROPERTY

Posted on: 18th Aug, 2008 10:43 pm
My parents are both dead and the home is in their names. How can we (7 children) transfer the home into the name of one sibling? Parents had no will. We are all in general agreement to putting one person's name on the deed. How can this be done speedy and inexpensively? My name is Richard. My email address is "luciel.1@sbcglobal.net"

Hello luciel.

Welcome to the forums.

Your parents had no will. So the property will be distributed among the heirs according to the Intestate Succession Law in your state. Then you can quitclaim the property to the one sibling as you all are in general agreement to putting one person's name on the deed.

Feel free to ask the community if you have further questions.

If your parents are dead, they cannot sign a deed. Therefore, you must get a court order to transfer the property. A court order regarding a decedent's estate is handled in probate court. Contact a probate attorney in your area.
