My brother died 9/7 without a will. I called the mortgage co. (Citi) & advised them of his death & they said they couldn't tell me a thing without a death certificate & or quik claims deed. would a Quik claims deed be helpful and what does it involve? Brother never was married. We will sell the house but in the interim the payments must be paid??? Probate will take months and the house won't sell for months after. No life ins. policy. The house is worth 200.000/balance 90000. Can I just pay the interest per month? Everything takes time to receive but the bills must get paid. I thought the mortgage co. would be able to advise me but without these papers they won't talk to me. I can't pay this 1000 a mo. for house note.

a quitclaim deed helps a person to transfer the property to another person. this deed only transfers the property and not the mortgage. to transfer the mortgage, either refinancing or novation is required.
if your brother had quitclaimed the property to you before death, then you can show the deed and the death certificate to the bank and they will help you. if he did not quitclaimed the property to you, then you have file an affidavit of heirship in the county recorder's office and you can show the document to the bank. i guess this will help you.

House has REverse-Morgage on it: I've been there every other weekend, including the one when upon my return because the house had beeen broken into twice; she died the next day, Dec. 22, 2008 at which I was there when AV Hospital in Lancaster, Ca, phoned me concering my mother's heart rate being too low. I need to make sure bills, taxexs, etc. are still being paid, as B of A has "frozen" her acct. However, she has some bills "SurePay" which are automatically deducted. Can a "freeze" by the bank affect those accounts ? Thanks, RLL

If the bank freezes the account, then the creditors won't be able to make automatic deductions from the account. You should make sure that you inform the creditors about the same and pay the bills on time.
