My dad owned a home and is not yet paid off, he passed away and with now will. We would like to get the mortgage transfered into his current wife's name, how do we go about with that? Who is actually eligible for the quit claim when there is no will?
looks like your Dad's estate is headed to probate. in that case, the partition of the property and any other pieces of his estate will be taken care of there.
you cannot get a mortgage transferred from one person's name to another's. that should not have any negative effect on anything at all, however.
you ought to seek out an attorney who might be able to help you with estate questions.

hi!
welcome to forums!
you have mentioned that your father had not left a will. if that case, the heirs to the property can file an affidavit of heirship at the county recorder;s office and get the property transferred in their name.
as far as the transferring of mortgage is concerned, his current wife needs to refinance the mortgage in her name. in order to refinance the mortgage in her name, she will need to have a good credit score.
feel free to ask if you have further queries.
