My mom and dad had property together. They divorced but in this paper id states that upon his death his 3 children are to get the property. Well before my dad passed he signed it over to my aunt witha quit cliam deed. My aunt (dads sister) hAS RECENTLY DONE ANOTHER QUIT CLIAM DEED OR SOLD IT . What can I do about the orginal papers between my mom and dad? was it leagl for my dad to sign a quit cliam deed even though it was suppose to go the his children?
Hi Dana.
Welcome to the forum.
You mom and dad own the property together .... right. So has you mother also signed the quitclaim deed? If she has not signed the deed then you may get her share of the property. I think you should contact with a real estate attorney and take help from him.
BTW if your mother has also signed the quitclaim deed then you have no claim on the property as it is already quitclaimed.
Feel free to ask if you have any further questions.
Best of luck,
Larry
