my uncle just passed but he had a quit claim deed on his property. my mother purchased the property which included his land also but now that he is dead where does the land go to? his heirs or back to my mother. the deed states, ten dollars and other good and valuable consideration to the undersigned grantor, name, (herein referred to as grantor), in hand paid by the grantee herein, the receipt whereof is acknowledged, the said grantor, does by these presents, grant, bargain, sell and convey unto name, (herein referred to as grantee), the following real estate.it list the parcel of land and then it states, this conveyance is hereby made subject to restrictive convenants, rights of way, easements and reservations of record that apply to the hereinabove described real property. to have and to hold the above-granted premises unto the said name, his heirs and assigns forever.
I would think if it was included in the quitclaim it would go to your mother. If you are saying that it was included.

Did your mother buy the property from your uncle and was that after the quit claim?
In that case, when your mother was buying that, the land was already owned by someone else. She had to buy that from the new owner.
