quit claim

Posted on: 10th Dec, 2009 11:30 pm
me and my father bought a house when i was on my single years. i got married and left the house to him and signed a quit claim i didn't ask for any of my share in the house. he got re-married and they are now living together for 5 years. now my father signed a quit claim on that house we bought and signed it over to my brother and sister. can his current wife still have rights over that house if they divorce.
Hi rodrigo,

If the property was solely in your father's name, then his current wife will not be able to claim any rights over it. Moreover, as your father has now quitclaimed the property to your brother and sister, they are the owners of the property. Thus, the current wife does not have any rights to that property.

Take care.
