Parents name on deed but not on loan

Me and my ex-husband's name is on the loan of the house and he signed a quit claim. It is now me and my parents that is on the deed but they are not on the loan. I want to move out and sell the property but they do not want to sign a quitclaim and does not want to take over the payments either, I opted for them to buy the house from me for the current market value (lower that how much we bought it before) but they said they will not qualify and cannot afford to make payments on their own. What are my options and how can I sell the house if they're name is on the deed? I don't want to forclose the house because I don't want to ruin my credit. I really want to move out and not live with them anymore. I want to start a new life with just me, my husband and my kids and not live together with my parents. Please help!!!:(

This is really a tricky situation

You really need to talk to them and exaplin your situation.

So sad to see that parents are not being helpful to their childern.

Hi cathy,

You can file a partition lawsuit. Once you file this lawsuit, the court will judge the whole situation and order for the sale of the property. Once the property is sold off, the mortgage for the property will be paid off first. If there's an excess amount, then it will be divided between you and your parents.
