Quit Claim Deed

Posted on: 16th Feb, 2008 09:09 am
my brother was tricked into signing a quit claim deed by his father. my brother has the mortgage on the home but signed the quit claim deed under lies. ( he was told by his father that it only gives his father access to the land the house is on.) he signed it not thinking it was a big deal. my brother now has to pay his father rent to live there and signed a lease. is there any suggestions on what he needs to do to get out of this mess? the deed was signed only in his fathers name.
Hi Stephanie,

Welcome to the forum.

Once a quitclaim deed is signed and then notarized and recorded in the county recorder office, it becomes very difficult reverse the quitclaim deed. But as you have said your brother has been tricked by his father, he should contact with an attorney ASAP and try to fix the problem.

AS his father tricked him to sign the quitclaim deed, I think he should be able to get the property back on his name.

Best of luck,
Larry
