Hello,
My mother now has my grandfathers POA. In regards to a cono unit.
As it reads now when it sells, my mother gets half, the other half goes to my grandfathers brother. Can my mother now legally change the deed to just be in her name. Also, in regards to land, can she change that into her name?
Thank You,
Mary

Hi mleathers,
It depends on the type of POA she has got and the rights she has been given. If the POA mentions she has the right to change the title to the property, she can change that to her name. Otherwise, she cannot.

it does state covers...
-real estate matters
-personal property
-estate and trust...and much more.
I just wasn't sure if she could change something that was done before she had POA.
Thanks so much

Hi mleathers,
You cannot change change the will and transfer the property to your name even though you hold POA. The person who gave you the POA, can prepare another will if he/she wants to, as long as he/she is competent. Moreover, the person can also revoke the POA anytime he/she wants to.
Thanks,
Jerry
