Power of Attorney

Posted on: 15th Sep, 2009 05:00 pm
When my mother died 10 years ago my dad did a quitclaim deed to put me on the house. Now he is sick and might face going into a nursing home. I want to protect my dad's interest. I have power of attorney for him and wanted to know if I can do a quitclaim deed and take him off of the house and just have my name.
Hi Christine!

Welcome to forums!

You can remove your father from the property deed by asking him to sign a quitclaim deed. Or you can sign the deed on behalf of him if you have a power of attorney. However, you should note that if your father transfers the property to you know, he would become ineligible for the medicaid benefits for the next 5 years.

Feel free to ask if you've further queries.
