I took payments over on a property. A quitclaim was obtained. I payed the Trustor each month and paid the property completely on 12/12/07. The origional owner died, leaving the property to his daughter, who died and now the grandaughter has everything in probate. I want a clear title. Who can legally be called the trustee on the above said order ?

Hi theretiredplumber,
I would like you to elaborate on the quitclaim deed that was obtained. Were you included in the title. As for your question on who would legally be the trustee, well, anyone who's given the legal power by the trust to manage the trust on behalf of the trustor, is a trustee. Thus, the granddaughter, as it appears, is also a trustee.

As previous poster mentioned, you need to clarify what your asking a little bit. The quitclaim was from who to who? Also a substitution of trustee and deed of reconveyance is essentially a release of the mortgage lien - a deed of reconveyance is recorded with the county to release the lien, this document comes from the trustee (usually a title co.).
