my husband and i purchased a property several years ago and we had my mother on the title. as she became older she wanted to make sure we would not have any legal issues after she passed away and we completed a quit claim deed that was signed and notarized. the document was never recorded. my mother passed away a couple of years ago and this year we were going to get an equity loan and since her name was on the title, they needed her signature. we explained she passed away and that we have a quit claim deed but they say we needed to fix the title first before they could process the equity loan.

If the quit claim has not been recorded that means, it is not valid.
Generally, when a co-owner passes away, whether it was a joint tenant or tenant in common, the land registry will automatically remove his/her name from the title on production of the death certificate.

You should have recorded it in your state's county recorder office to make it a valid deed. Now you should talk to an attorney to transfer the title to your name. When the title will be transferred to your name, you can be able to apply for the loan.
