my girlfriend's ex husband signed a quit claim deed on the property they had together. he would not sign the document unless she agreed to sign a seperate document stating if she ever sold the house he could get half the profit up to 12000.
is that document valid or will the quit claim deed over ride it. my problem is if i marry her and refinance the home in our names and live there for years, i don't plan to pay her ex-husband any money if we sold the property.
what is the best course of action in this situation?

Hi jason!

If your girlfriend signs an agreement with her ex-husband and agrees to give him a portion of the sale proceed, then that agreement will stand valid. She will be responsible for paying him a particular amount from the sale proceed. Your girlfriend should contact a real estate attorney and take his opinion in this matter.
Feel free to ask if you've further queries.
