Should I sign the quit claim deed?

Posted on: 10th Feb, 2009 12:55 pm
we are in a property dispute with our neighbors and our fence was installed 1 1/2 foor on their property 4 years ago and they moved in 11 months ago. they want me to sign a quit claim deed. i am not sure if i have to sign it or can i just move my fence?? they have a lawyer and we don't. the lawyer is telling us that we have 20 days to sign the form or it will go to quiet title lawsuit. i just don't understand..
Hi misty,

A quitclaim deed is a legal process of transferring your share of interest in the property to someone else. I don't understand what a quitclaim deed has to do with this issue. It's a different issue and if you had installed the fence on their property, you can just move it back. So, I would suggest you not to sign on any quitclaim deed without knowing what you're signing on and what its terms are.

I don't understand either. Your fence is on a 1 1/2 foot strip of the neighbor's property so what would you be quitclaiming, your neighbor's land? They're going to do a quiet title action on their own land? I would suggest you try to talk to your neighbor and determine what you can do, would moving the fence resolve the issue, etc.
