Who has the rights him or me?

my husband and i have divorced this year and he signed a quit claim deed. now the escrow company wants to give him half the escrow check, the taxes, and the interest for this year because we were both on the loan for our house. i got the house in the settlement and now he thinks he should get monies from this. i have tried to tell the escrow company that he does not get it but they said since we had the loan together he gets half. i believe that to be wrong since i was the one who paid off the old loan and he was not on the paperwork only me. the new loan is in my name only now. what do i do to inforce the quit claim deed he signed?

The fact that he signed the quit claim deed makes you the sole owner of the property. But as his name was mentioned in the mortgage earlier he will receive his share of the escrow check, taxes, etc. Do you have any documents stating that you paid off the loan alone? if yes, then you can contact the lender and check out if he can help you in this regard.

Hi kaboehlke,

you need to show proof that motgage is currently being paid from your earnings only. your ex is not contributing any thing now. it will definetely help you

Did you provide the settlement paperwork to the Escrow Officer? If yes, and they're still going to pay your husband, it's time to get your Divorce Attorney involved.
