how should I go about a quit clam deed, with warranty

my wife's aunt lives with her husband in a duplex. the landlord is tring to transfer owner ship to my wife and i with a quit claim deed , it belonged to her and her deceased husband and he is still in the tittle will this affect anything.with cash in return what should i do to protect my self . thank you

It its a gift transfer, i.e. if the landlord is trying to transfer the property as a gift to you and your wife then a quitclaim deed is perfectly alright. However, if you are paying an amount for the property, i.e. if you are purchasing the property then it will be better if you go for a warranty deed.

Hi cmcpride,

If the landlord wants to transfer ownership, he should use a deed to make the transfer effective. If the deceased husband's name is on title, then it needs to be removed by using an Affidavit of Heirship.
