quitclaim deed while purchasing a new house

Posted on: 24th May, 2010 03:36 pm
Hi,

While purchasing a new house, my husband made sign a quitclaim deed whith knowing what I was signning. We had just sold our other house and we were using the money for down payment. Now that we are divorcing, He says that I have no ownership of the house. Is that true?
Hi breanda!

Welcome to forums!

If you signed a quit claim deed and transferred the property to your husband, then you won't be having any rights to that property. You will have to check out whether or not your name is mentioned in the property deed. If not, then you are not an owner of that property.

Feel free to ask if you've further queries.

Hi Breanda,

I can understand your state of mind but in this situation you need to check the property deed in detail. If you have signed the quitclaim deed then your husband is the sole owner of the property now. The best thing for you would be to consult with a good lawyer and check out the options open for you.
