My husband purchased our house a couple of weeks before we got married then did a quit claim so my name is on the deed. Now a year later we are getting a divorce and he wants the house back. Can the courts make me give it back or quit claim it back to him? His attorney is trying to say it's not a marital property because it was before our marriage (even though I'm the one that dealt with the bank, real estate agent etc.).
Hi sadsack!
Welcome to forums!
As the property was purchased before marriage, it won't be considered as a marital property. However, as your name is on the property deed, you have ownership rights toward the property. You need to let the court know that you want to keep the property. The court will take a decision in regards to your claim and let you know whether or not you would be able to keep the property.
Feel free to ask if you've further queries.
