Quit Claim Deed

Posted on: 11th Feb, 2010 12:51 pm
i am in the process of getting a divorce from my husband and because i have bad credit he is helping me with refinancing my home. he stated that later he wants his name taken off the title. my question is? do i give him the quit claim deed to sign when we sign the documents of the house or how long should i wait to have him sign.
hi yolie!

welcome to forums!

you've mentioned that your husband will be helping you with the refinance. in that case, his name would remain on the mortgage docs. it would be his discretion whether or not he wants to transfer the property to you now by signing a quit claim deed. in my opinion, when you refinance the loan solely in your name after your credit improves, you can ask him to sign a deed and remove his name from the property. thus, he won't remain the owner of the property and will not be responsible for paying off the mortgage dues.

feel free to ask if you've further queries.
