I currently am still married to my spouse. I have not lived with him for about 7 years. I want to legally divorce him, but we own this home together. We currently owe about 90,000 on the home and the value is around 175,000. I want to sign it over to my husband, and be done with the whole situation. Then I can divorce him and hope he won't ask for anything else. What should I do?
You can quit claim your name off the property but he will have to refinance the mortgage into just his name so it doesn't affect your credit.

Hi Guest.

Welcome to the forum.

Are you on the mortgage also? If you are on the mortgage then your husband should refinance the mortgage on his name as you quitclaim the property to him. BTW you can even ask your husband to buy you out. Means pay you for your share of equity.

Feel free to ask if you have any further questions.

Best of luck,
Larry

My spouse and I have been separated for about a year. He moved out, I have remained in the house with our 2 adult children. I have also taken over the mortgage payment. If I choose to buy him out, how much will it cost me.

Hi cindy,

This will depend upon how you can negotiate with your spouse and also on the value of the property.
