What am I entitled to?

my ex-boyfriend and i bought a house dec 2005. both our names are on the deed and mortgage.

he put the downpayment ($3,000) on the house. he originally told me he had enough for a downpayment or an engagement ring, not both, which would i prefer. i chose the downpayment on the house and we decided on the house and living together. we did not split the bills 50/50, the agreement was that he would pay the mortgage while i would pay all the other bills. i also purchased most of the items for home improvement since we bought the house "as is"


we broke up in march 2007 and since he made conditions unbearable for me to live there i had to move out and find places to live in april 2007. we had reconciled in april 2008 and i moved back in at the end of may 2008 and paid ½ the mortgage payments but again things got unbearable and i had to move out again in september 2008. things were pretty intolerable in the house from july through september.

he lost his job last month but still managed to get approved to refinance the home & now wants me to sign over the house. how do i determine what i am entitled to? what happens if we can't agree to anything and i don't sign the quit claim deed?

It's very difficult for me to ascertain how much you're entitled to. But I think you should make a list of all the expenses you incurred on the home improvement and payment of bills. You should also try and find out what the current value of the house could be. This can give you a rough idea about what you might be entitled to.

If you do not sign the quitclaim, you remain on the title and can claim an interest in the property in future. As long as you're on the title, your ex-partner cannot sell it without your consent.
