i certainly hope you answer this question...my current wife and her ex cohabitated in the same household during their marriage. he left her in 2005 and moved to orange co. during the marriage, she purchased the home that they lived in and a condo. his name never appeared on any of the documentation for either property. she has quit claims on both properties showing her as sole owner, married. now, some 4 years later, he wants a share of the refinance of the condo...however, the condo and the house was foreclosed on over the past 2 years and given back to the bank. is he legally entitled to any of the proceeds from any refinancing simply because they were married or is he s.o.l?
If his name is not on title/deed, he has not rights to the property. He also does not have any rights to any cash proceeds of any refinance loan taken out. I hope this helps...
