i have asked my husband for a divorce after 17 years we have tried to refinance the house so he can stay in it. i do not want anything from it but because we are current on the payment the mortgage company will not do a refinance on it we are up side down about 30,000.00 on it. if i sign a quick claim deed to him will that free me of any responsibility on the mortgage? we both have good credit and i would like to keep it that way. my next question is if the quick claim deed is out of the question is it wise to skip two payments so that the mortgage company will then look at us to do a refinance?
as your property does not have any equity, the lenders will not be ready to provide you with a refinance. skipping payments won't help your husband to get a home loan refinance. signing a quit claim deed will not remove you from the liability of paying off the mortgage. it will only remove you from the property.

Your situation is too complicated to explain it briefly. There are many aspect that might influence the final result. So the best advice is to see a lawyer and check all options together. There might be other things at play you might not be aware of.
And I wouldn't risk skipping payment's - it wouldn't do any good to you and your husband.
