i have sent the quit claim deed which he has not filed. he had 6 months to refinance home which was a year ago. he was then supposed to put the house on the market. instead he is renting it out and i am still listed on the mortgage. he has stayed current on the payments. i don't know what his credit score is currently. i assume its not good if he hasn't refinanced. he is remarried and lives with his new wife. can i get him to assume loan if mortgage company approves or try to force him to sell.

When you got divorced,did you ever discussed these issues (or put it on paper) related to the responsibilities of the mortgage.I think you should contact an attorney and then ask him to send a legal notice to abide to the divorce decree clauses.
If he is unable to refinance on his own due to poor credit score,you can ask him to cosign with his new wife and thus problem could be resolved.
If he is current on the payment then mortgage company can not force him to sell the property just because he is not ready to assume it.
Instead you should approach an attorney from your locality and he/she will be able to guide you on this front with more accuracy.
