i and my husband bought a home 12 years ago. we had credit problems because he lost his job and got behind on some bills. in order to get caught up we decided to refinance the house but because most of the credit was in my name my credit was lousy, so the mortgage company convinced me to not be on the mortgage and quit claim deed to my husband which i did. i have paid the mortgage even though it was in my husband's name since the refinance even after he got another job. the job never paid well enough and he quit again and then was without work on an dpff for the ;ast few years.; all the while i have taken care of all bills including the mortgage. now he is talking divorce and while i don't want the house i will need money to move out with the children as he also insists it his house. do i have a case to get something? can i reverse the quit claim he will never resign a quit claim? help!
Hello and welcome to the forum- You can do a new quit claim that essentially reverses the first. Husband will have to sign it. Talk to a divorce attorney, you may not have that much to be concerend about as far as the porperty goes. Just because you quit claimed your name off, doesn't mean you don't have any interest in it, especially in a marriage. Good luck.
