Quit Claim, Refinance and Divorce

Posted on: 24th Jan, 2009 07:36 am
i live in va. my husband deserted me a year ago to be with the wife of his friend. before moving out, he signed a quit claim deed in the presence of a notary, and i filed the paper with the county. he was removed from the title on the house. now a year has passed and he wants to divorce. i need to refinance in order to remove his name from the mortgage contract. he also wants me to sell the house within a year and give him 50 percent of any profit from the sale. does he have any rights to the property?
Hi kkellum,

As he has already quitclaimed the property to you, I do not think he has any rights on the property neither can he demand money from the sale of the property. As far as transferring the mortgage is concerned, you can refinance the mortgage in your name.

Thanks.
