Quit Claim Deed VS Refinance

Posted on: 03rd Feb, 2010 08:31 am
my divorse should be finalized in a few weeks. we agreed that i should get the house. i have her paid her the 50% split equity of the house in the settlement. do i need to refinance to get her name off of the title/mortgage or can i have her sign a quit calim deed? it would cost me $6000.00 to refinance and i would receive a worse interest rate compared to what i currently have. please let me know.

thank you for your help.

Hi pjesh,

In order to remove your spouse's name from the property deed, you'll have to ask her to sign a quit claim deed in your favor. Once she signs over the deed, you will have to refinance the loan in your name.

Thanks
