i bought a house with my husband and now we have decided to get a divorce. he doesnt want to keep the house...i would lik eto know how can i get his name off the house without refinancing? can i use the quit claim deed?

is your husband also on the mortgage?

in that case, signing a quit claim deed will only take away his name from the title but not the loan. to remove his name from the mortgage you have to either refinance it in your name or do a novation.

you have to talk to your lender about this.

Hi Michelle,

I think Jenkin is right. If your husband signs a quit claim deed then you will be the sole owner of the house. But still his name will be on the mortgage. So if you want to remove his name from the mortgage, you have to refinance.

Transferring the title to your name includes so many complicacies. If your husband agrees to sign the deed then it is all right. Otherwise you have to face problems. So I would suggest you to consult with a legal adviser
