my ex and i agreed that i would sign a quit claim deed and he refinanced the house at the same time. i signed and the new title company made me sign as a witness to his new loan. she also wrote in there that i was signing only to remove my obligation on the homestead. now he is being forclosed on and i got served papers...what can i do to protect the property i have now and can someone touch my current property because of this? the kids and i moved into a house with my mother and she put my name on this house just in case something happened to her but it is her house.
Hi amypenrod,
If your ex refinanced the loan in his name, then you are not liable for the loan payments. The lender cannot come after you for the payments. If the lender is coming after you for the payments, you should inform them about the refinance. If the lender still harasses you, then you can contact your attorney and take legal action against the lender.
Thanks

He refinanced in his name, so, you are not obligated to pay anything for his mortgage
You signed a quticlaim deed, so, you are not an owner.
You are divorced, so it does not seem you own anything together nor do you have any community property rights per chance you are in a community property state.
If all those are correct, you do not owe anyone anything and no one can go after your current property
