Deeds, refinancing, and death

my husband bought a home before we were married. we refinanced the home with my name on the refinance papers three times using my credit. when refinancing the home with both spouses names on it, does the finance company change the deed. he passed away without leaving a will. everything we owned was in both our names, and recently i found out that the deed was not changed and there is nothing recorded at the courthouse on the home with my name on it. i have been paying the house payments and taxes on the home for over five years. the home was changed over into my name when he passed away with the finance company. i'm not sure what i need to do.

If your name is not mentioned on the property deed, you need to file an affidavit of heirship at the county recorder's office and get it transferred in your name. Then you can refinance the mortgage in your name if your name is not mentioned on the mortgage docs.
