Quit Claim

my wife and i divorced in september, 2008. she actually moved out in may 2008 without a separation agreement. i have been maintaining the home on my own since then. i have been approved for a refi, but now she is refusing to sign the quit claim deed. what options do i have and what entitlements would she have if the quit claim is not signed?
Sorry, I left out that this property is in the state of GA. Any information at all would be appreciated.

snoopy this seems unusual. didn't your divorce decree mention the division of the property? and, of course, i'm baffled by the lack of an agreement, if that's the case. were there no legal minds at work on this divorce?

i'm sorry - i have no knowledge of Georgia law, but felt the need to ask. i'm sure i've been of little help here.

Welcome to forums!

I agree with George Akerley here. It would have been better if you had an agreement stating that your wife would have quitclaimed the property to you and that after the divorce, you will be the owner of the property. I think you should check the divorce decree and see if there is any such clause mentioned in it.
