DEAR SIR:
I HAD A COMMON LAW HUSBAND FOR 17 YEARS AND WE HAD PROPERTIES WE PRODUCED DURING OUR COHABITATION. I HAVE 4 CHILDREN WITH HIM. IN THE YEAR 1997, WE GOT SEPARATED AND I WAS PRESSURED TO SIGN A QUIT CLAIM STATING THAT I HAVE FOREVER QUIT MY INTERESTS AND RIGHTS ON OUR PROPERTIES FOREVER. I SIGNED IT COZ OF SO MANY FAMILY PROBLEMS BETWEEN US AND FAMILY. REALIZING EVERYTHING, THE AMOUNT I RECEIVED WAS NOT THAT SUFFICIENT FOR OUR PARTNERSHIP.THE CORPORATION WAS UNDER MY NAME AND HIS; DO I STILL HAVE A CHANCE TO DEMAND THE PROPERTIES WE HAD ACQUIRED? AND UNFORTUNATELY HE JUST DIED THIS JANUARY OF 2009. MY CHILDREN ARE GETTING THEIR CLAIMS AS HEIRS BUT THEY TRY NOT TELL ME ABOUT THE CORPORATION I HAD WITH HIS DAD. PLEASE MAKE A COMMENT ON THIS. Since you have signed the quitclaim deed, releasing all your interest in the property, you cannot claim your property-share back. If you can reverse the deed by proving that you were pressurized to sign the deed, you can claim your interest back. You should consult an attorney regarding this.
