Quitdeed Claim

Posted on: 18th Feb, 2013 12:43 pm
My wife passed away a couple of years ago and both our names are on the deed. I have since remarried and want to know if i need to file a quitdeed and have my wife's name added to the deed. Or can I state in my will that all property goes to her even though my late wife's name is still on the deed.
Hi Smitty!

Welcome to forums!

You will have to file an affidavit of heirship at the county recorder's office and get the property transferred in your name. Then you can add your new wife to it. This will make it easier for her to claim the property upon your death.

Feel free to ask if you've further queries.

Welcome Smitty,

It will be better if you could get in touch with a real estate attorney and he will help you further in this regard.
