When a spouse passes away is it necessary to get the deceased removed from the house by filing a quitclaim deed?
the house owner can do a quitclaim deed to anyone before one's death. If the owner didn't do this and passed away, the quitclaim deed will not happen. if there is a survivorship in the house, when the owner passed away, the family member can get the property.
Hi,
If there is rights of survivorship mentioned in the deed, then the entire property automatically passes on to the surviving owner. You have to record the death certificate at the county clerk's office. The rest of the procedure depends on the laws of the state where you live. You have to consult a lawyer for that.
